RAPID CITY, S.D. A man convicted of sexually abusing a young girl while he was stationed in security forces at Ellsworth Air Force Base in South Dakota is seeking a new trial.
Forty-seven-year-old Frank Ashley was sentenced four years ago to 135 years in prison for convictions on sex crimes.
Ashley has petitioned the court for a new trial, saying his attorney did not do everything he could to defend him and that his constitutional rights were violated.
An attorney asked to review the case by the Pennington County State’s Attorney’s Office says the handling of the case by Ashley’s trial attorney met acceptable defense standards.
Judge Robert Mandel asked for written briefs from both sides by the end of the year.
