First, a little about me. After 10 years of AD USAF time, I joined the ANG. I know how I would answer some of the following situations as an AD guy, but I'm not sure about the Guard.

At what point does a Guardsman's Duty, his Oath to defend the Constitution et all, no longer apply (nuclear war, suspension of the Constitution, coup 'd etat, CinC makes a power grab, Nationwide Martial Law under shady pretenses, etc.) When does that which he pledged his life to protect longer exist to the point where he is released from his responsibilities, even if the established local command structure still exists? How would one justify one's decision to no longer report to duty to one's superiors?

As an AD member, I watched the Katrina aftermath with interest. I saw 2nd Amendment rights violated, unlawful searches and seizures, and more. I'm not sure I could follow orders to violate Constitutional rights in such a case, but I don't know where my decision would lead once things got back to normal. According to my understanding of the law, an AD member is required to disobey an unlawful order to disarm a private citizen without just cause. I am unsure how that works for a Guardsman.

I don't care for the new regulations and "exceptions" that were enacted under Bush. I care about what's morally right, to hell with what the "law" says.

Advice for this new Guardsman?
