I an an Army veteran, forced into medical retirement after serving 19 years, 4 months, and 26 days. I am not eligible for CRDP because I did not serve 20 years of military service.

Upon my retirement, I was also required to pay into the SBP program if my wife instisted. Though I do want to pay into this program, the idea of being forced to pay out of my retirement pay is very displeasing. This SBP plan ensures my wife and children receive a portion of my retirement pay upon my death. A Supreme Court decision ruled that spouses of deceased-disabled veterans paying into the SBP can receive both DVA DIC pay and SBP pay (disregarding the concurrent pay issues of the past).

I am rated at 100% disabled from the Department of Veterans Affairs, so I lose all retirement due to current concurrent receipt issues. My SBP payments are being deducted from my DVA disability compensation. The only way I can truly receive any retirement pay is upon my death. Is this right?
