View Full Version : Inactive duty marine WANTS BACK IN... but there's a problem.

i served in iraq more than 4 years ago. on my leave back home in NY i hooked up with a girl. Not knowing she was only 16 her parents pressed charges against me. i was able to finish up my time but after that i had to go back to NY and go to court for the charges. Stupid me didn't RE-Enlist before hand. i got a horrible lawyer who did nothing for me so i was charged for sexual misconduct A Misdemeanor and given 6 years probation. i'm half way through my probation, and even my probation officer agrees that it was just a stupid mistake that i made as well as the judge who i went in front of. I am technically still in the marines listed as inactive duty until this November, i was discharged honorably. i want back in but people tell me that i can't because of my probation. i'm looking to request an early termination of my probation but was wondering what the corps would be able to do for me to help me out, if anything. i was 23 and stupid when i made the biggest mistake of my life, if i were to wait until my probation was up i would be almost 30 when i am able to go back in. i really don't want to wait that long. i want to continue to make a life for me and my family. anyone have any advice, or know anything that anyone can do to help my situation would be greatly appreciated.

they won't let you in on probation. you cant even be in the DEP while on probation. the military cant do a whole lot to help you, its up to the judge, and it prolly won't be lightened.. trust me.. i've been on probation and what not before

The only thing you can do is try every avenue possible, give it your best effort, and at the end of the day if it didn't work -- at least you tried.

Get a decent lawyer, make a formal request to have the probation terminated, and have character witnesses (your recruiter would be a fantastic idea, maybe a pastor or other society-trusted figure too) lined up and ready to help you out. You might just be surprised. If what you say is true, you've already served 3 years probation. The Judge might just see a guy who made a dumb mistake as a young man, and has served ample penalty and wants to serve his Country again. He might just decide to lift your probation.

You'll never know until you try.
